The Subclass 494 visa, also known as the Skilled Employer Sponsored Regional (SESR) visa, is an Australian visa designed to support regional businesses and address skill shortages in designated areas. It allows eligible regional employers to sponsor skilled overseas workers for positions they are unable to fill with appropriately qualified Australian workers.

Available Streams – Subclass 494 Visa

The Subclass 494 visa has three streams:

1. Employer Sponsored Stream: For skilled workers sponsored by regional employers facing labour shortages and unable to find qualified Australian workers.

2. Labour Agreement Stream: For skilled workers nominated by employers under a labour agreement with the Australian Government.

3. Subsequent Entrant Stream: For family members of Subclass 494 visa holders who want to join the primary visa holder in Australia.

What are the steps involved in applying for an Australian Subclass 494 visa?

First, your occupation must be on the relevant skilled occupation list issued by the Department of Home Affairs. 

Second, you must ensure that you meet all the general eligibility requirements for the Subclass 494 visa, as well as the specific criteria for the particular visa stream you are applying under. Once you have confirmed your eligibility, you can ask your employer to submit a nomination on your behalf.

Third, before you can apply for a Subclass 494 visa, your employer must first lodge a nomination application with the Department of Home Affairs. While the exact requirements may vary depending on the visa stream, in general, the employer must demonstrate that:

1. Their business is lawfully and actively operating in Australia.

2. They have genuinely advertised the position but were unable to find a suitable Australian worker.

3. There is a genuine need for the nominated position within the business.

4. They have a legal employment contract in place with you.

5. The proposed salary meets or exceeds the Australian market salary rate.

What Are the Requirements for the Subclass 494 Visa?

 

To be eligible for the Subclass 494 visa, you must satisfy both the general eligibility criteria and the specific requirements for the visa stream you are applying under.

 

Requirements for the Employer Sponsored and Labour Agreement Streams:

To qualify, you must:

• Have an occupation listed on the relevant skilled occupation list.

• Be nominated by an approved Australian employer.

• Have at least three years of full-time work experience in your nominated occupation.

• Hold a positive skills assessment that confirms your qualifications, skills, and work experience.

  • Note: A skills assessment is mandatory for the Employer Sponsored Stream.

  • For the Labour Agreement Stream, a skills assessment may not be required if not specified in the labour agreement.

• Have at least Competent English to be granted this visa.

• Be under 45 years of age at the time of application.

• Have a good character and meet health requirements.

• Not have had a visa cancelled or a previous visa application refused.

The Requirement for Subsequent entrant subclass:

• This stream is for a family member of a main applicant of a SESR 494 visa or of a primary SESR visa holder. You must satisfy this requirements: 
•  You must be nominated by the employer who sponsored the primary SESR visa holder/applicant. This means that the work sponsor (employer) must agree to include you as a family member in the nomination.  
• You must show that you have Functional English. If you don’t meet the English requirement, the additional cost of AUD will be applied. This extra cost is called as a second instalment.  
• You must have a good character record and be of good health. 
• You have not had a visa cancelled or a previous application refused

You can be exempt from age limit requirements in following cases:

You may qualify if you:

• Have been nominated by an Australian university to work as a university lecturer or faculty head at Academic Levels B, C, D, or E.

• Have been nominated by an Australian scientific government agency to work as a scientist, researcher, or technical specialist at ANZSCO skill level 1 or 2.

• Hold a New Zealand citizen family member visa (Subclass 461) or a Special Category visa (Subclass 444), and have worked in the nominated position for your sponsoring employer for at least 2 years within the last 3 years.
