Subclass 309 is a temporary visa and serves as the first step toward obtaining the permanent Subclass 100 visa. The application process occurs in two stages: first, you will be granted the Subclass 309 visa. Then, two years after the date you applied for the 309 visa, you will need to apply separately for the Subclass 100 visa.

 

Are You Eligible for a Partner Visa Subclass 309?

 

To be eligible for the Partner Visa (Subclasses 309/100), you must meet all of the following requirements:

• Location: You must be outside of Australia at the time you lodge your Partner Visa application. 

• Sponsor: You must have a sponsor. Your spouse or de facto partner must apply to be your sponsor at the same time you submit your visa application.

• Age: Both you and your partner must be at least 18 years old.

• Visa History: You may not be eligible for this visa if you have previously had a visa cancelled or refused while you were in Australia.

Relationship Requirements

 

To be eligible for the Partner Visa (Subclass 309), you must demonstrate that your relationship is genuine, continuing, and that you are living together. Periods of separation are allowed, but only if they are temporary.

For De Facto Relationships:

• You and your partner must have been in a de facto relationship for at least 12 months immediately before lodging your visa application.

• Please note that time spent dating does not generally count toward the 12-month requirement.

Exemptions from the 12-Month Cohabitation Requirement:

You may be exempt from the 12-month cohabitation requirement if any of the following apply:

1. Compelling and compassionate circumstances exist that justify the grant of the Subclass 309 visa.

2. You have formally registered your de facto relationship with an Australian authority (such as a state or territory registry of births, deaths and marriages).

3. Your partner:

   • Holds or held a permanent humanitarian visa, and

   • Your relationship existed before that visa was granted, and

   • Your partner informed the Department of Home Affairs of your relationship before the visa was granted.

Health Requirements

 

You and any family members included in your application must pass a health examination at a medical center approved by the Department of Home Affairs.

Even family members who are not coming to Australia with you might also need to meet the health requirements.

Character Requirements

 

You and any family members included in your application must provide police checks for each country you have lived in for 12 months or more over the past 10 years.

Debt to the Australian Government

 

You must not owe any money to the Australian Government, or you must have made arrangements to repay it.

Eligibility for a partner permanent visa subclass 100:

 

• Hold a Subclass 309 visa (temporary offshore partner visa).

• Still be in your marriage or de facto relationship, unless there are special circumstances.

• Have followed all Australian laws and the conditions of your 309 visa.

Who Can Sponsor for a Partner Visa (Subclass 309/100)?

 

To apply for the offshore Partner Visa (309/100), you must have a sponsoring partner.

The Sponsor Must:

• Be an Australian citizen, Australian permanent resident, or an eligible New Zealand citizen.

Sponsorship Limits:

• Can only sponsor two partners (spouse or de facto) in their lifetime.

• Can only sponsor one partner every 5 years, unless there are exceptional circumstances.

• Cannot have been sponsored themselves on a partner visa in the past 5 years.

Character Requirements for the Sponsor:

• Must not have been convicted of or fined for offences involving harm to a child.

• Must pass a character check.

How Can You Prove Your Relationship with Your Partner?

 

The relationship is one of the most important parts the case officer will consider when deciding on your partner visa application. To show that your relationship is genuine, continuing, and mutual, you need to provide evidence in several key areas:

   Write about key moments like how you met, when you moved in together, got engaged or married, time apart, and your future plans. Include your marriage certificate or registered relationship document.

3. Household Life
   Provide proof of living together, mail addressed to both, and any joint responsibility for children. Include a statement about your household arrangements.

4. Social Life
   Show invitations, proof of joint activities, common friends, and travel together. Write about your social life as a couple.

5. Commitment
   Provide evidence of knowing each other’s personal details and staying in touch when apart.

مدارک مالی مشترک

شامل حساب بانکی مشترک، قرارداد اجاره یا وام مسکن، قبوض مشترک و توضیحی درباره نحوه مدیریت مالی زندگی مشترک

زندگی خانوادگی

ارائه مدارکی مبنی بر زندگی در یک محل، نامه‌ هایی با آدرس مشترک، مسئولیت‌ های مشترک مربوط به خانه یا فرزندان (در صورت وجود) و توصیف شیوه اداره خانه

روابط اجتماعی

مدارکی مانند دعوت‌ نامه‌ ها، عکس‌ ها، سفرهای مشترک، دوستان مشترک و شرحی از فعالیت‌ های اجتماعی به‌ عنوان یک زوج
